The short version. We host and look after an online ordering system for your restaurant. You are responsible for the food, the menu and the prices; we are responsible for the software being there when a customer taps order. There is no contract length and no cancellation fee — leave whenever you like and take your data with you. We do not touch your money.
These terms apply to the online ordering system supplied by Integrated Business Solutions ("we", "us"), of Cathlamet, Washington.
We are not your point of sale, your payment processor, your accountant or your bookkeeper. We do not hold or handle your money at any point. Where card payments are taken, they run directly between your customer and your payment company, on your merchant account, under your agreement with them.
We are not going to quote you a percentage. A number like "99.9% uptime" from a business this size would be a marketing line, not a commitment, and you would have no way to hold us to it. Here is what we do instead, and you can check any of it:
If the system is unavailable for a significant part of a day and it was our fault, tell us and that month is free. If we lose any of your data, we will say so plainly, restore what we can from backup, and tell you exactly what was lost.
The ordering system needs your internet connection to be working. If your connection drops, or your power goes out, new orders will not arrive and your screens will stop updating. Your till, your phone and your kitchen printer carry on exactly as they did before — this system cannot take your restaurant down, only stop adding to it.
We also depend on services we do not control: the company hosting the server, your till provider, your payment company, and the mobile networks that carry text messages. We will tell you what has happened and chase it, but we cannot promise what we do not run.
Your menu, your orders and your settings belong to you. Ask and we will give you a copy in a readable format, at no charge, whether or not you are leaving. If you stop using the service we will keep your data for 30 days in case you change your mind, then delete it. We will never hold your data to get you to stay.

Fees, if any, are agreed with you in writing before they start, and are billed monthly. Some restaurants pay nothing — early customers who helped shape this are on that basis and we will not quietly start charging them.
There is no minimum term and no cancellation fee. Stop whenever you want, by telling us. We will take your ordering page down on the date you ask, give you your data, and that is the end of it. If we ever change what we charge you, you get at least 30 days' notice, and you can leave rather than accept it.
We improve it regularly and updates arrive automatically, usually without you noticing. If a change alters something you rely on, we will tell you before it happens rather than after.
You can stop at any time, for any reason. We can stop if fees agreed in writing go unpaid after we have asked, if the system is being used for something unlawful, or if we simply cannot continue to support you properly — in which case we will give you at least 30 days' notice and help you move.
We will do this carefully and honestly, but we are a small business and we have to be clear about the edges. Except where the law does not allow it to be limited, our total liability to you in any twelve-month period is limited to what you paid us in that period. We are not liable for lost profits, lost sales, or other indirect losses. The service is provided as it is; we do not warrant that it will be uninterrupted or error-free, and we have told you above exactly what we do instead of pretending otherwise.
Nothing here limits liability for anything that cannot lawfully be limited.
These terms are governed by the laws of the State of Washington. If something goes wrong between us, the first step is a phone call.
Your order is with the restaurant, not with us. We build and run the ordering page on their behalf. The restaurant cooks the food, sets the prices, and is who to talk to about your order.
Prices and what is available come from the restaurant and can change. Some dishes are limited to a set number a day, so a thing that was there this morning may be gone by the evening. If something sells out between you adding it and placing the order, we will tell you, take it out, and nothing is charged for it.
A restaurant can also stop taking online orders at any time — a bad night, a short-staffed shift, a broken fryer. The menu stays readable and their phone number stays on the page.
The time you are quoted is the kitchen's best estimate based on how busy they are. It is not a guarantee. On a bad night it may be longer.
Ordering ahead to eat in reserves your food, not a table. If the restaurant is full when you arrive you may still have to wait for somewhere to sit, exactly as you would walking in.
If you or anybody you are ordering for has a food allergy, telephone the restaurant rather than relying on a typed note. Kitchens are not allergen-free environments and a note can be missed during a rush. The restaurant would much rather have the conversation.
Where a restaurant offers it, the catering link is an enquiry, not an order. Nothing is reserved, no price is quoted and no card is taken. It puts your name and number in front of the restaurant so they can ring you and work it out with you. If nobody has called you within a day or two, please phone them — an enquiry is not a booking until you have spoken to somebody.
Contact the restaurant directly and as soon as possible. Once food is being cooked it may not be possible to cancel. Any refund is the restaurant's decision and, where a card was used, is processed by their payment company.
Placing orders you do not intend to collect wastes real food and real money from a small business. Do not do it. Orders that appear to be fake may be refused, and repeated abuse may be blocked.
Alcoholic drinks are not sold through this system, whatever a restaurant serves in person.
The ordering page may remember your last few orders and your name and number on your own device, so you do not retype them. That stays on your phone and is never sent to us. There is a Forget me on this device button on the ordering page.
